1. Acceptance of Terms

By downloading, installing, or using Fumiq ("the Software"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Software.

2. Description of the Software

Fumiq is a cross-platform desktop application for exploring and managing message queues such as Azure Service Bus. The Software runs locally on your device and connects directly to your messaging infrastructure using credentials you provide.

3. License Grant

Subject to your compliance with these Terms and payment of applicable fees, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use the Software on devices you own or control, for your personal or internal business purposes.

You may not copy, modify, distribute, sell, lease, sublicense, reverse engineer, decompile, or disassemble the Software, in whole or in part, except as expressly permitted by applicable law.

4. Free Trial

We offer a free trial with access to all features. No payment information is required to start the trial. At the end of the trial period, you must purchase a license to continue using the Software.

5. Licensing and Billing

Fumiq is available as a one-time purchase. Each license includes 1 year of updates from the date of purchase. Current pricing is listed on our pricing page.

Our order process is conducted by our online reseller Polar.sh. Polar is the Merchant of Record for all our orders. Polar provides all customer service inquiries and handles returns.

6. Refund Policy

We offer a 30-day money-back guarantee. If you are not satisfied with the Software, you may request a full refund within 30 days of your purchase date by contacting us or Polar's customer support.

After the 30-day period, fees are non-refundable except as required by applicable law.

7. Data and Privacy

Fumiq is a desktop application. All your data, including connection strings, credentials, and message content, is stored locally on your device and is never transmitted to our servers. We do not collect, store, or have access to your messaging data.

The only external service the Software communicates with is Polar, solely for license validation. Payment and billing data is collected and processed by Polar in accordance with Polar's Privacy Policy.

8. Acceptable Use

You agree to use the Software only for lawful purposes and in compliance with all applicable laws and regulations. You are solely responsible for how you use the Software and for any actions taken through it, including the management of messages and queues.

We are not responsible if the Software is used for any illegal, unauthorized, or criminal activities. Any misuse of the Software is your sole responsibility.

9. Disclaimer of Warranties

The Software is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Software will be uninterrupted, error-free, or free of harmful components, or that any defects will be corrected.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Fumiq and its creators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, revenue, or business opportunities, however caused, whether in contract, tort, or otherwise, arising out of or in connection with your use of or inability to use the Software.

This includes, without limitation, any damage or data loss resulting from:

• Message operations such as sending, receiving, deleting, or dead-lettering
• Incorrect or unintended modifications to your queues, topics, or subscriptions
• Connection issues or interruptions to your messaging infrastructure
• Any actions taken by third-party services such as Azure Service Bus

In no event shall our total aggregate liability exceed the amount you paid us in the twelve (12) months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Fumiq and its creators from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of your use of the Software, your violation of these Terms, or your violation of any applicable law.

12. Intellectual Property

The Software, including its code, design, logos, and documentation, is the intellectual property of Fumiq and is protected by copyright and other intellectual property laws. These Terms do not grant you any ownership rights to the Software.

13. Termination

We may terminate or suspend your license to use the Software at any time if you breach these Terms. Upon termination, you must cease all use of the Software and delete all copies from your devices.

You may terminate these Terms at any time by cancelling your subscription and uninstalling the Software.

14. Changes to These Terms

We reserve the right to update these Terms at any time. We will notify you of significant changes by updating the "Last updated" date at the top of this page. Your continued use of the Software after changes are posted constitutes your acceptance of the revised Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law provisions.
